2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 504, 447, 307/34 of the Indian Penal Code.

3. As per the F.I.R., on the alleged date and time of occurrence, due to land dispute between the parties these petitioners, armed with deadly weapons, caused hurt on the head of informant.

4. It is submitted on behalf of petitioners that due to land dispute between the parties, this false and concocted case has been lodged. Accusation of assault is general and omnibus

Patna High Court CR. MISC. No.75087 of 2023(2) dt.29-11-2023 2/2 and no specific overt act has been alleged against these petitioners. There is case and counter case. Petitioners have got clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 468 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
