JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-10-2018 The petitioner has come for modification in order dated 9.7.2018 passed in Cr. Misc. no.35021 of 2018. Submission of the learned counsel for the petitioner is that in para 3rd of the order dated 9.7.2018, it has been mentioned that later on a case under Section 414 of the IPC was also lodged against the petitioner rather the charge-sheet has been submitted under Section 414 of the IPC. Further at page 2 of the order it has been mentioned that the petitioner has misused the privilege of the bail rather the petitioner was on police bail. Heard learned APP.

Having heard both sides and in view of the facts and circumstances of the case, in para no.3 of order dated 9.7.2018 passed in Cr. Misc. No.35021 of 2018, the sentences 'later on a case under Section 414 of the IPC was also lodged against him, be

Patna High Court Cr.Misc. No.60112 of 2018 (2) dt.03-10-2018 2/2 read as "later on the charge-sheet has been submitted under Section 414 of the IPC against the petitioner". Similarly at page 2 in third paragraph, the sentence 'as such he has misused the privilege of the same' be deleted. In view of the facts, let the petitioner surrender within a period of three weeks from the date of receipt of the order. Let this order be communicated to the court concerned at once.
