The petitioner seeks bail in Kasim Bazar P.S. Case No.177 of 2018 registered for the offence under Sections 30, 32 of the Bihar Prohibition and Excise Act.

Accusation is that in course of checking of the vehicle one Pick-up Van bearing Registration No.BR08G 3929 was intercepted by the police on which two persons were sitting one of them jumped from the vehicle and fled away but the driver of the vehicle was apprehended and on search 123 bottles each containing 750 ml. Indian made foreign liquor was recovered. Submission on behalf of the petitioner is that the petitioner is the driver of the vehicle and he is not owner of the vehicle. He had no knowledge about the seized liquor recovered

Patna High Court Cr.Misc. No.62482 of 2018 (2) dt.08-10-2018 2/2 from vehicle. He is in custody since 13.08.2018 having no criminal antecedent.

Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge-II-cum Special Judge, Excise Act, Munger, in Kasim Bazar P.S. Case No.177/18.
