2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 30 (a) and 32

(3) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that altogether 638.400 liters of country made liquor was recovered from a Pickup Van.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted petitioner no. 1 is the driver and petitioner no. 2 is the co-driver

Patna High Court CR. MISC. No.69298 of 2025(2) dt.25-09-2025 2/2 of the said vehicle. They were having no knowledge about the illicit liquor. Moreover, the petitioner is languishing in judicial custody since 07.08.2025 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Hajipur Excise P.S. Case No. 245 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise -II cum Additional District and Sessions Judge, Hajipur (Vaishali).
