1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code as well as Section 8 of the POCSO Act.

3. Learned counsel for the petitioner submits that petitioner has antecedent of two cases and the informant alleges that his daughter was kidnapped by Umesh Manjhi for which Hisua P.S. Case No. 299 of 2021 was instituted and trial commenced. It is further alleged that the accused persons were threatening to withdraw the said case and his daughter since 17.04.2023 is missing, thus, alleges that the victim was

Patna High Court CR. MISC. No.69911 of 2025(2) dt.13-10-2025 2/3 kidnapped by Umesh Manjhi with the help of the named accused persons including the petitioner who is father of Umesh Manjhi.

4. Learned counsel for the petitioner submits that petitioner, being the father of Umesh Manjhi, came to be falsely implicated in the instant case by the informant. It is further submitted that Umesh Manjhi and daughter of the informant were in love and they eloped and performed marriage and out of the wedlock, a child was born. It is next submitted that Umesh Manjhi was taken in judicial custody and he has approached this Court seeking regular bail by filing Cr. Misc. No. 37246 of 2025 and the same came to be allowed by an order dated 18.06.2025 passed by a learned Coordinate Bench of this Court. It is, thus, submitted that no useful purpose would be served by sending the petitioner to jail who is father-in-law of the victim.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-

No.69911 of 2025(2) dt.13-10-2025 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Hisua P.S.
