Petitioner seeks bail in Excise Case No.841 of 2018 arising out of Jehanabad P.S. Case No.679 of 2018 instituted for the offence under Section(s) 30(a), 38, and 47 of the Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that petitioner is driver of the vehicle. He has clean antecedents. He is in custody since 26.08.2018.

It is alleged that one vehicle was apprehended by the police and 192 bottles foreign liquor total 101.625 litres was recovered from the vehicle. The petitioners along with other accused persons as named in the First Information Report were

Patna High Court Cr.Misc. No.63193 of 2018 (2) dt.25-10-2018 2/2 found sitting in the vehicle. Petitioner is said to be driver of the vehicle.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Jehanabad, in connection with Excise Case No.841 of 2018 arising out of Jehanabad P.S. Case No.679 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
