Petitioner prays for bail in connection with Daraunda P.S.Case No. 231 of 2017 registered for the offence punishable under Section 394 of the Indian Penal Code.

Allegation is of committing dacoity against accused persons and petitioner is not named in the FIR. However, it appears that petitioner is accused in 10 other cases. Submission of learned counsel for the petitioner is that he has been made accused on the basis of confessional statement of co-accused and thereafter remanded in 10 other cases and he has not been put on TIP, nothing has been recovered from his possession and he is in custody for six months. Heard learned APP also.

No.63024 of 2018 (2) dt.25-10-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XI, Siwan, in connection with Daraunda P.S.Case No. 231 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that if petitioner is named in such type of cases in future, his bail bond shall be cancelled.
