The petitioner is apprehending his arrest in connection with Excise Case No.C2-22 of 2015 , registered for offences punishable under Sections 47(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution report, there is recovery of 260 kg. of Jawa Mahua and 15 ltrs. of country-made liquor from the house of the petitioner.

Submission of the learned counsel for the petitioner is that he had no knowledge about the same as such he could not appear earlier and the offence is under the old Act. Heard learned A.P.P. also.

Having heard both sides and in view of the facts

Patna High Court CR. MISC. No.64555 of 2019(2) dt.15-10-2019 2/2 and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the court below and make prayer for regular bail, which will be considered on its own merit and if possible to be disposed of on the same day .

With the aforesaid observation, this application is disposed of.
