Petitioner seeks bail in a case registered for the offences punishable under Sections 30A, 56B of the Bihar Excise Act, 2016.

595 Litres sprit was recovered from a pickup van and the petitioner was found sitting in the aforesaid pickup van. The prosecution claims that petitioner was driver of the aforesaid vehicle but submission on behalf of the petitioner is that the petitioner was not driver of the said pick up van and as a matter of fact, the petitioner is a truck driver and his truck got some mechanical defect as a result whereof he took lift in the said pickup van leaving behind his truck but unfortunately he was

Patna High Court Cr.Misc. No.65942 of 2018(2) dt.22-11-2018 2/2 caught by the excise officials whereas the driver of the aforesaid pickup van managed to escape from there.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that para 3 of the petition reveals that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya in connection with Excise (Sherghaty) Case No. 283 of 2018.
