JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Civil Lines P.S. Case No. 258 of 2019 registered for the offence punishable under Section 409 of the Indian Penal Code.

As per FIR petitioner was put under suspension for taking Rs.1500/- more from a student and further allegation is that he has not handed over the charge of the school and kept the keys of the school with him.

Submission of learned counsel for the petitioner is that now suspension has been revoked and he has joined the school and whole allegation is false and he is ready to abide by any condition that may be imposed on him.

Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.68579 of 2019(2) dt.25-10-2019 2/2 petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Civil Lines P.S. Case No. 258 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to co-operate in the investigation as well inquiry pending against him.
