The petitioner seeks bail in connection with Turkauliya P.S. Case No. 436 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that the petitioner shot fire upon Abhay Kumar @ Tufani by his country made pistol which hit on right shoulder.

Learned counsel for the petitioner submits that the coaccused Sabit Devi, informant of Turkaulia P.S. Case No.437 of 2019 has also sustained injury. She was admitted on 02.07.2019

Patna High Court CR. MISC. No.66987 of 2019(4) dt.18-12-2019 2/2 in Sadar Hospital and referred to higher center then admitted on 06.07.2019 in Sri Krishna Medical College and Hospital, Uma Nagar, Muzarrarpur and discharge from there on 10.07.2019. He further submits that as per allegation Sadhu Yadav shot fire upon Sabita Devi, informant of Turkaulia P.S. Case No.437 of 2019 by which she sustained fire arm injuries. Learned counsel for the petitioner further submits that there is case and counter case and both parties had received the injuries. Petitioner is in jail custody since 03.07.2019. Learned counsel for the petitioner further submits that the petitioner has no criminal antecedent. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkauliya P.S. Case No. 436 of 2019.
