The petitioner seeks regular bail in connection with Pandarak P.S. Case No.68 of 2017 registered for offences punishable under Sections 376/34 of the Indian Penal Code. Allegation against the petitioner of committing rape upon the daughter of the informant aged about 18 years. Submission of learned counsel for the petitioner is that medical report has not supported the prosecution story of rape and petitioner is in custody since 31.07.2017.

Heard learned A.P.P. also who has opposed the prayer for bail and stated that from impugned order, it appears that girl has also stated in her statement under Section 164 Cr.P.C. for committing rape.
