The petitioner has prayed for bail in a case registered for the offence punishable under sections 363, 366-A, 506/34 of the Indian Penal Code and section 12 of the POCSO Act. As per allegation in the FIR, while the daughter of the informant was found missing from her house, a search was made by her family members. During search, they came to know that petitioner along with h is friend had kidnapped her for marriage purpose.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There is delay of eight days in lodging in FIR without any valid reason. Victim girl has not whispered the name of the
Patna High Court CR. MISC. No. 69098 of 2022(4) dt.10-05-2023 2/2 petitioner for any sexual assault. Age of the daughter of the informant has been accessed as 19-10 years by the lower court. Petitioner has got no criminal antecedent and he is languishing in judicial custody since 8.10.2022.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, POCSO Act, West Champaran at Bettiah in connection with Jogapatti P.S. Case No. 527 of 2022.
