The petitioner is languishing in custody since 05.08.2019 in a case registered for the offences punishable under Sections 379 and 411of the IPC.

The prosecution case is that the petitioner was apprehended committing theft of jewellery from the neck of the informant in a temple.

It is submitted by learned counsel for the petitioner that on the basis of mere suspicion, the petitioner has been roped in the present case and the investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court CR. MISC. No.69319 of 2019(2) dt.27-11-2019 2/2 Learned APP submits that the petitioner was caught on the spot along with the snatched jewellery.

Considering the nature of accusation, period under custody and the fact that the investigation has already been concluded, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM-I, Jhanjharpur, Madhubani in connection with Bhairab Asthan P.S. Case No. 103 of 2019.
