Petitioner apprehends arrest in connection with Chhapra P.S. Case No. 310 of 2022 registered for the offence under sections 147, 145, 146, 197 of the Railway Act to which section 153 of the Railway Act was added later on. Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case merely on basis of the confessional statement of the coaccused. Except confession of the co-accused, there is no material against this petitioner. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.75275 of 2023(2) dt.01-12-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing personal bond to the satisfaction of Railway Judicial Magistrate, Sonepur in connection with Chhapra P.S. Case No. 310 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
