The petitioner seeks bail in connection with Excise Case No.423 of 2019, arising out of Ramgarh P.S. Case No.146 of 2019, registered for the offence under Sections 420, 467, 468, 34 of the Indian Penal Code and Sections 30(a), 56(i)(ii) of the Bihar Prohibition and Excise(Amendment) Act, 2018. Accusation is that on receiving secret information, the informant along with police personnel reached the place of occurrence(bricks-kiln), where a pick-up van was seen standing and after seeing the police party, one person, namely, Amrit Kumar (the petitioner) tried to flee away, but he was arrested. It is alleged that from the pick-up van, 1611 bottles containing 180

Patna High Court CR. MISC. No.67434 of 2019(2) dt.27-11-2019 2/2 ml. each of foreign liquor were recovered.

Submission is that the petitioner is the driver of Pickup van and he had no knowledge about loading cartoons of liquor. Further submission is that the petitioner has no criminal antecedent and he is in custody in the present case since 25.06.2019.

Having considered the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge(Excise), Kaimur at Bhabua in connection with Excise Case No.423 of 2019, arising out of Ramgarh P.S. Case No.146 of 2019.
