JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2018 Earlier prayer for anticipatory bail of the petitioner was allowed by this Court vide order dated 20.6.2018 passed in Cr.Misc.No. 21913 with condition to surrender within a period of six weeks and now this application has been filed for modification of the said order stating that due to illness petitioner could not surrender within the time prescribed.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, I am not inclined to interfere with the earlier order. However, if petitioner surrenders and make prayer for regular bail, learned court below shall consider this aspect of the matter that earlier anticipatory bail was granted to the petitioner and dispose of the same, if possible, on the same day. With the above observation, this application is disposed of.
