Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 353, 307, 504, 506 and 427 of the Indian Penal Code and

Patna High Court CR. MISC. No.1705 of 2023(2) dt.19-06-2023 2/3 section 27 of the Arms Act.

It is alleged that about 80 unknown accused persons including these petitioners pelted stones and damaged police vehicles.

It is submitted that the petitioners are innocent and have falsely been implicated in this case due to dirty village politics. The specific allegation of firing and pelting stones is against other co-accused persons and there is general and omnibus allegation against these petitioners and no overt act is alleged against them. Similarly situated co-accused persons have already been granted bail by the Co-ordinate Bench of this Court vide order dated 25.11.2022 passed in Cr. Misc. No. 59936 of 2022.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali (Belsar O.P) P.S. Case No 493 of 2021, subject to the conditions laid down under section 438(2) of the Code of criminal
