====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-10-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 126(2), 109(1), 352 of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. Informant, namely, Vicky Kumar alleged that on 13.06.2025 at about 5:30 PM, all the F.I.R. named accused persons, including these petitioners, came at the house of informant and made indiscriminate firing.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Both parties are co-villagers and due to petty dispute, this false and

Patna High Court CR. MISC. No.70467 of 2025(2) dt.08-10-2025 2/2 concocted case has been lodged. Though there is allegation of firing but no one sustained any firearms injury. He further submits that during course of pendency of the case, dispute between the parties has already been resolved and joint compromise petition has also been filed before the learned court below (Annexure-2). Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Biharsharif, Nalanda in connection with Chhabilapur P. S. Case No. 83 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
