Mr. Ganesh Prasad Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 10-12-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners seek bail in connection with Mansi P.S. Case No. 124 of 2025 instituted for the offences punishable under Sections 137(2), 96, 303(2) and 3(5) of the BNS, 2023.
3. As per the prosecution case, the accused persons kidnapped the daughter of the informant (victim) with an intention to marry her.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence and have falsely been implicated in this case merely on the basis of village politics. He submits that the petitioners kick out the informant and her husband from their houses. He next submits
Patna High Court CR. MISC. No.68585 of 2025(3) dt.10-12-2025 2/3 that there is no allegation of kidnapping or abduction against the petitioners. He lastly submits that there is no case is made out against the petitioners. Petitioners have got clean antecedent as stated in para 3 of the petition is in custody since 31.07.2025.
5. Learned APP for the State opposes the prayer for bail.
6. From perusal of the FIR, case diary and impugned order of the learned District and Additional Sessions Judge-1st, Khagaria dated 29.08.2025, it appears that petitioners are named in the FIR. From perusal of the records, it appears that the accused persons namely Shiva Chaudhary, kidnapped the daughter of the informant with an intention to marry her and fled away. When the informant went to the house of co-accused namely Manoj Chaudhary, Putul Devi and Ranjo Devi, they pushed out the informant. Considering all these aspects of the case and submissions of learned counsel for the petitioners, the allegations against the petitioners seems frivolous and, thus, I am inclined to grant bail to both the petitioners.
7. Accordingly the prayer for bail of the petitioners are allowed. Let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction
