JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 This is an application for grant of anticipatory bail in connection with Chapra Town P. S. Case No. 175 of 2019, disclosing offences under Sections 363 and 365 of IPC. As per F.I.R. petitioner has given threatening to the husband of the informant to withdraw the case lodged under Section 307 of IPC by the husband of the informant against the petitioner. Thereafter, he has gone for plucking the flower, but did not return and he is still trace-less.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case on on suspicion and except that there is nothing against him and postmortem report also disclosed that cause of death could not be ascertained. He is brother of the deceased.

Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Saran at Chapra, in connection with Chapra Town P. S. Case No. 175 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he will appear before the I.O. within 10 days of his release. It is also made clear that during the investigation if any serious incriminates appears against him, prosecution is at liberty to move for cancellation of his bail bonds.
