====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-10-2025 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application with regard to petitioner no. 2.
2. Permission is granted.
3. This anticipatory bail application with regard to above named petitioner no. 2 is, accordingly, dismissed as withdrawn.
4. Heard learned counsel for the petitioners and the State.
5. Petitioner no. 1 apprehends arrest in a case registered for the offences punishable under Sections 329(3), 126(2), 115(2), 109, 351(2), 352, 3(5) of the Bharatiya Nyaya

6. It is alleged that due to land dispute, this petitioner along with other F.I.R. named accused persons came at the place of occurrence and on the order of this petitioner co-accused Arvind Kumar Singh assaulted on the head of informant with iron rod.
7. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is owner of the plot adjacent to the plot purchasaed by the regisered sale deed no. 7526 dated 28.06.2016 and dispute arose between the parties on account of demarcation of land in question. Petitioner is only alleged to be the order giver and there is no allegation of assault agains him. Specific accusation of assault by means of iron rod is against co-accused Arvind Kumar Singh. Petitioner claims clean antecedent.
8. Learned A.P.P. for the State vehemently opposed the bail application.
9. Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner no. 1 in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on

No.70102 of 2025(2) dt.07-10-2025 3/3 furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Danapur in connection with Danapur P. S. Case No. 710 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
