Petitioner, who is in custody, seeks bail in connection with Rail Bhagalpur P.S. Case No. 142 of 2018 registered for the offences punishable under Section 401 of the Indian Penal Code.

Informant who is Sub-Inspector of Rail Police, Bhagalpur has stated that in course of patrolling duty at about 8:45 on platform no.1 he found petitioner along with two other persons in suspicious conditions and seeing police party tried to flee away thereafter they were chased and caught, on search two pieces of Baldes were recovered from the pocket of the pant of the petitioner.

Patna High Court Cr.Misc. No.63946 of 2018(2) dt.29-10-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Nothing has been recovered from his possession. He has been arrested on suspicion only. Petitioner is in custody since 15.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Railway Bhagalpur, in connection with Rail Bahaglpur P.S. Case No. 142 of 2018.
