The petitioner seeks bail in connection with Baisi P.S.Case No. 164 of 2017 registered under Section 306 of the Indian penal Code.

In the written report, it is alleged that on 01.08.2017 at about 8:00 P.M., petitioner took away minor daughter of the informant, aged about 15 years, for the purpose of marriage and stayed anywhere in the night. In the next morning, petitioner and daughter of the informant came and seeing them, one of the villagers namely Bhela tried to apprehend them but petitioner fled away and girl came in the house of the petitioner but all accused persons named in the written report ousted the victim girl from the house. The victim girl came back to the house of the petitioner to live in but she was again ousted from the house.

Patna High Court Cr.Misc. No.62641 of 2018(2) dt.11-10-2018 2/2 The informant found dead body of his daughter in front of house of the petitioner at 3:00 P.M. The informant has alleged that girl has taken poinson on instigation of petitioner and other accused persons.

Learned counsel for the petitioner submits that mere suspicion has been raised against the petitioner. The petitioner is in custody since 04.08.2018 and has no criminal history. Considering the aforesaid fact and circumstances, the prayer of bail of the petitioner is allowed. The petitioner, abovenamed, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Purnia in connection with Baisi P.S. Case No. 164 of 2017.
