The petitioner is accused in connection with Aurangabad Town P.S. Case No. 102 of 2018 registered under Sections 307 and other allied Sections of the Indian Penal Code. The accusation is that the informant being SubInspector, Police Line Aurangabad, was on duty to maintain law and order on the eve of Ramnavmi procession on 25.03.2018. When the procession reached at the G.T. Road, some miscreants of Musilim Community started to pelting stones, as a result whereof, Magistrate and police personal received the injuries. At that time, both sides started raising slogan against each and started setting fire. Thereafter, 80 persons were apprehended and

Patna High Court Cr.Misc. No.62287 of 2018(2) dt.06-10-2018 2/2 38 persons named in the F.I.R. including the petitioner succeeded to flee away.

Learned counsel for the petitioner submits that petitioner is not apprehended at the spot rather his name has come mere on suspicion. Further submission is that petitioner was apprehended in the present case on 17.05.2018 and thereafter he remanded in Aurangabad P.S. Case No. 110 of 2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P.S. Case No. 102 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
