2. The petitioner has preferred this application for grant of regular bail in connection with Sitamarhi P.S. Case No. 56 of 2024 dated 23.06.2024 registered for the offences punishable u/ss 302, 304B, 201 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and the coaccused persons are alleged to have killed the informant's daughter due to non-fulfillment of demand of Rs. five lakhs, T.V. and refrigerator as dowry.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is the mother-in-law of the deceased and she has no concern with the alleged offence. There is general and omnibus allegation against the petitioner. The petitioner neither
Patna High Court CR. MISC. No.78120 of 2024(4) dt.19-03-2025 2/2 demanded any dowry nor tortured the deceased. The co-accused person has already been granted regular bail by this court vide order dated 15.02.2025 passed in Cr. Misc. No. 85171 of 2024. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is a lady and as per the impugned order dated 29.08.2024, she is in custody since 28.06.2024.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nawada in connection with Sitamarhi P.S. Case No. 56 of 2024.
7. The application stands allowed.
