The petitioner is accused in connection with Sarairanjan P.S. Case No. 105 of 2018 registered under Section 272 and 273 of the Indian Penal Code and Sections 30(a) and 38(i) of the Bihar Excise Act, 2016.
The accusation is of recovery of 5 bottles each containing 750 ml and 11 bottles each containing 180 ml Indian made foreign liquor from the house of the petitioner. Learned counsel for the petitioner submits that the alleged Indian made foreign liquor is said to be recovered from the joint house, in which, petitioner and other family members used to reside in the house. Patna High Court Cr.Misc. No.62295 of 2018(2) dt.06-10-2018 2/2 has no criminal antecedent and is in custody since 18.07.2018.. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge VI- cum- Special Judge, Excise Act, Samastipur, in connection with Sarairanjan P.S. Case No. 105 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
