2. The petitioner has preferred this application for grant of regular bail in connection with Jurawanpur P.S. Case No. 31 of 2023 dated 18.03.2023 registered for the offences punishable under Sections 341, 323, 504, 506, 307, 379/34 of the I.P.C. and Section 27 of the Arms Act.

4. As per the prosecution case, on 09.03.2023, the petitioner and the co-accused persons are alleged to have assaulted the son of the informant. When the informant came to rescue his son, he was also brutally assaulted by them. The petitioner assaulted the informant with iron rod causing head injury. The other accused persons assaulted the informant with

Patna High Court CR. MISC. No.74463 of 2024(2) dt.18-10-2024 2/3 weapons on his left palm and other parts of the body due to which he sustained injury. They also took Rs. 50,000/-from the informant and his son's shop. On 27.02.2023, the co-accused, Dharmendra Singh had threatened to assault him.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. It is further submitted that the petitioner is alleged to have given an iron rod blow on the head of the informant and the injuries sustained by the informant and his son are simple in nature as it is evident from the injury report. The co-accused person has already been granted anticipatory bail by this court vide order dated 07.11.2023 passed in Cr. Misc. No. 63169 of 2023. The petitioner has two criminal antecedents as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 11.07.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
