The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420 and 499 of the Indian Penal Code.

As per the prosecution case, on 29.07.2022 at about 10.45 am, this petitioner sent message through his e-mail ID to the District Magistrate, Patna by using designation of the SubDivisional Officer, Banmankhi, Patna, Purnea for the purpose of forgery.

It is submitted that petitioner has been falsely implicated in this case due to mala fide intention. The allegation levelled against the petitioner is false and concocted. It is next

No.69229 of 2022(2) dt.05-05-2023 2/3 submitted that on 13.07.2021 an application was given before the Hon'ble the Chief Minister Programme in Janta Darbar in which matter was reported regarding irregularities in Saat Nishchay Yojana in Gram Panchayat Sahuriya Subhay Milik, Ward No. 4. thereafter, a letter was issued by the District Panchayat Raj Officer to District Public Grievance Officer, Purnea for action. The letter which is the basis of this case, from perusal of which it is clear that the name of the Sub-Divisional Officer was written in place of the petitioner by mistake. Even if the prosecution case is assumed to be true at best it is a case for the offence under Section 419 of the Indian Penal Code. No offence under Sections 406, 420 of the IPC are made out. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Janki Nagar P.S. Case No. 214 of 2022, subject to the conditions as laid down under Section 438(2) of the Code
