====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 07-11-2023 Heard Mr. Brij Nandad Prasad, learned counsel appearing on behalf of the petitioners and Mrs. Renu Kumari, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Panjwara P.S. Case No. 77 of 2023 registered for the offence punishable under Sections 341, 323, 308, 379 and 504/34 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., co-accused Niranjan Das gave iron blow on the head of the informant with an intention to the kill the informant. The petitioners are said to have snatched the ornaments of the informant.

4. Learned counsel appearing on behalf of the

No.71399 of 2023(2) dt.07-11-2023 2/2 petitioners submitted that the main allegation of assault is against the co-accused Niranjan Das and general and omnibus allegation has been alleged that the petitioners have snatched the ear ring and golden chain respectively from the wife of the informant. Petitioners have clean antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the allegation being general and omnibus in nature, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Panjwara P.S. Case No. 77 of 2023 , subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) mantreshwar/- U T
