The petitioner has filed the instant application for grant of regular bail in connection with Udwant Nagar (Gajraj Ganj) P.S. Case No. 52 of 2022 registered under sections 20(b) ii (b)/29 of N.D.P.S. Act.

Prosecution case relates to recovery of 4kg and 26 grams of ganza like narcotic substance from the house of the other co-accused, namely, Jitan Singh.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous village enmity. His name has been transpired in this case on the basis of

Patna High Court CR. MISC. No.72182 of 2022(2) dt.18-03-2023 2/2 confessional statement of apprehended co-accused, namely, Jitan Singh before the police. It is further submitted that no any seized ganja like substance has been recovered from the conscious possession of the petitioner and also he has no concern with the alleged recovery. He is languishing in judicial custody since 28.09.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Udwant Nagar P.S. Case No. 52 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, N.D.P.S. Act, Bhojpur at Ara. (Sunil Kumar Panwar, J) shubham/- U T
