2. In the present case, the petitioner seeks bail in connection with Chandi P.S. Case No. 97 of 2025 registered for the alleged offences under Sections 96, 137(2) of BNS.

3. As per prosecution case, the petitioner and coaccused fled away with the granddaughter of the informant giving her inducement of marriage.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case and no occurrence as alleged has ever taken place. The petitioner and the granddaughter of the informant were in love

Patna High Court CR. MISC. No.69459 of 2025(2) dt.08-10-2025 2/3 and they eloped and solemnized marriage. The statement of the victim girl was recorded under Section 183 BNSS and she stated that she willingly solemnized the marriage with the petitioner. She did not allege any sexual assault or violent force against the petitioner. She went on to live with the petitioner at Mumbai out of her sweet will. She has refused to undergo any medical examination. Learned counsel further submits that after their marriage, victim girl was called back by grandfather and he has accepted the marriage. The petitioner is aged 21 years having clean antecedent. The petitioner is in custody since 09.07.2025 and charge sheet has been submitted.

5. Learned APP opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the statement of the victim girl and further considering the period of custody of the petitioner, his clean antecedent and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bhojpur at Ara/concerned Court in connection with Chandi P.S. Case No.

Patna High Court CR. MISC. No.69459 of 2025(2) dt.08-10-2025 3/3 97 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
