The petitioner seeks bail in Excise Case No.596 of 2018 arising out of Bihariganj P.S. Case No.182 of 2018 registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Accusation is that the petitioner was apprehended by the police in suspicious condition on cycle and on search 38 liter mahua liquor kept in a bag was recovered.

Submission on behalf of the petitioner is that he is in custody since 26.07.2018 having no criminal antecedent. Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.

Considering the facts and circumstances of the case, as
