The petitioner seeks bail in a case registered under Sections 395, 397, 412 of the Indian Penal Code. Allegation is that twenty unknown miscreants armed with deadly weapon including pistols entered in the house of the informant and looted away jewellary of about Rs.36 lakhs, cash Rs.2 lakhs and mobiles.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.6.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the basis of suspicion. One mobile is alleged to have been recovered. Same

Patna High Court CR. MISC. No.63687 of 2019(2) dt.22-10-2019 2/2 has not been put on T.I.P. to ascertain whether same is looted article or not. There is no recovery of any incriminating article from the petitioner. The petitioner has not been put on T.I.P. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. case No.207 of 2019.
