The petitioner seeks regular bail in connection with S.Tr. o.417 of 2018 arising out of Salaiya P.S.Case no.10 of 2014 (G.R.No.389/14) registered for offences punishable under Sections 147, 148, 149, 341, 307, 353, 124A of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act, Section 3⁄4 of the E.S. Act and Section 17 of the CLA Act.. Three persons were arrested from the spot and they have disclosed the name of the petitioner and others. Apart from that he is accused in ten other cases.
Submission of the learned counsel for the petitioner is that except the confession there is nothing against the petitioner and other accused, who have been arrested at the spot have already been granted bail, vide order dated 9.1.2015 passed in Cr. Misc. No.31452 of 2014, order dated 10.12.2015 passed in Cr. Misc. No.49574 of 2015 and order dated 2.4.2019 passed in Cr. Misc. No.17189 of 2019. he is in custody since
Patna High Court CR. MISC. No.69791 of 2019(3) dt.05-02-2020 2/2 22.6.2018. Charge has been framed .
learned A.P.P. and perused the report from which it appears that in this case charge has been framed but not a single witness has been examined.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge 2nd, Civil Court, Aurangabad (Bihar) in connection with S.Tr. No.417 of 2018 arising out of Salaiya P.S.Casae no.10 of 2014 (G.R.389 of 2014) with condition that one of the bailors must be local one having sufficient property within the jurisdiction of the civil Court, Gaya and further condition that he has to appear in the trial as and when required, otherwise his bail bond shall be cancelled..
With the above direction, this application is allowed.
