Mr. Sri Asharaf Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 The petitioner seeks bail in connection with Madhuban P.S.Case No. 43 of 2018 registered under Sections 302/34 of the Indian penal Code.

Allegation, as per the FIR, is that six accused persons entering inside the house of the informant cut the throat of her husband causing his death.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and other accused persons, who are also named in the FIR, have been granted bail by the co-ordinate Benches of this Court vide order dated 22.11.2018 passed in Cr. Misc. No. 61282 of 2018 and order dated 22.11.2018 passed in Cr. Misc. No. 62718 of 2018 and petitioner is in custody since 26.04.2018. Heard learned APP also.

No.68602 of 2018(2) dt.03-12-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Motihari, East Champaran in connection with Madhuban P.S. Case No. 43 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
