2. The petitioner seeks bail in connection with Gaya Cyber P.S. Case No. 173 of 2024 instituted for the offences under Section 318(4), 319(2), 336(3), 338, 340(2), 111, 61(2) of the B.N.S., 2023 and Section 66(C), 66(D) of the I.T. Act.

3. As per prosecution case, the petitioner and other accused persons were running a call center and were committing Cyber fraud.

4. The petitioner has renewed his prayer for grant of regular bail which was earlier rejected by this Court vide order

Patna High Court CR. MISC. No.69171 of 2025(2) dt.22-09-2025 2/3 dated 11.04.2025 passed in Cr. Misc. No. 15773 of 2025 on the ground of nature and gravity of the offence.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 01.12.2024 i.e. for almost nine months. He further submits that the charge-sheet has been submitted on 25.02.2025 against the petitioner for offence under Sections 318(4), 319(2), 336(3), 338, 340(2), 111, 61(2) of the B.N.S., 2023 and Section 66(C), 66(D) of the I.T. Act. but, the charge has not been framed as yet and, thus, there is no likelihood of conclusion of the trial in near future. He further submits that the co-accused persons have already been granted bail by this Court vide order dated 22.08.2025 passed in Cr. Misc. No. 59236 of 2025.

6. Having heard learned counsel for the petitioner and taking into account that the fact that the charge-sheet has been submitted but, the charge has not yet been framed as also the period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

7. Accordingly, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/-

Patna High Court CR. MISC. No.69171 of 2025(2) dt.22-09-2025 3/3 (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Gaya Cyber P.S. Case No. 173 of 2024.
