1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Pakaridayal P.S. Case No. 35 / 2021 dated 02.03.2021 registered under Sections 120(B), 420, 465, 467, 468, 471 of the I.P.C.
3. As per the complaint-cum-first information report the land of the informant / complainant situated at Khata No. 197, Plot No. 2736 having an area of 10 dhurs has fraudulently been transferred by the petitioner and other accused persons. The informant / complainant had alleged that the land was given to her by her father and she has been residing in her house situated
Patna High Court CR. MISC. No.69435 of 2025(2) dt.08-10-2025 2/3 upon the said land.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case only because transfer deed was drafted by the petitioner, who by profession is a deed writer. The land in question fell in the share of father of Sonu Kumar namely, Ramadhar Dubey and the said Ramadhar Dubey transferred the said land on 15.09.2006 in favour of Sonu Kumar and Abhimanu Kumar. Sonu Kumar and others sold the aforesaid land on 10.02.2020 in favour of Lalan Dubey, who has also been made accused in the present case. The complainant / informant is not having any concern with the said land.
5. Regard being had to the submission made by the parties and taking into consideration the fact that the petitioner is merely a deed writer, accordingly , I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Motihari / concern court, Motihari, East Champaran in connection with Pakaridayal P.S. Case No. 35 / 2021 subject to
Patna High Court CR. MISC. No.69435 of 2025(2) dt.08-10-2025 3/3 the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
