2. The petitioner is in custody since 07.09.2023 in connection with Special Case No. 1288/2023 registered for the offence punishable under Sections 30(a)/32(3) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 192.00 litres of illicit liquor has been recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to enmity. He further submits that nothing has been recovered from the possession of the petitioner. The petitioner has clean

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IV cum Special Judge, Excise Act-II, Kishanganj, in connection with Special Case No. 1288/2023.

7. The petitioner is directed to mark his attendance in K. Hat police station on 1st Sunday of every month. (Sandeep Kumar, J) Saif/- U T
