2. The petitioner apprehends his arrest in connection with Maker P.S. Case No. 83/2025 registered for the offences under Sections 126(2), 115(2), 109, 352 and 3(5) of the BNS, 2023.

3. Allegedly, the petitioner along with other coaccused persons have brutally assaulted the informant leading to serious injuries. It is specifically alleged that this petitioner gave a knife blow on the head of the informant. .

4. Learned Advocate for the petitioner submitted that from the narratives made in the F.I.R., it is evident that both, the petitioner and the informant are own brothers. In fact, on

No.70265 of 2025(2) dt.08-10-2025 2/3 account of a dispute of ancestral property, both the families have entered into a scuffle resulting into unfortunate injuries to members of both the families. There is a counter version of the present case being Maker P.S. Case No. 84/2025 instituted by the petitioner against the informant and others. The injury which is alleged to have been sustained by the informant on his head was found to be simple in nature. To support the aforesaid contention, the copy of injury report has been placed on record as Annexure -P/3. The petitioner undertakes that he will fully cooperate in the proceeding of the Court and would not indulge in such kind of activities in future.

On the other hand, the learned Advocate for the State vehemently opposed the bail application and submits that specific allegation of causing knife blow has been levelled against the petitioner leading to serious injuries. 6.Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the genesis of the occurrence and the factum of case and counter case coupled with the simple nature of the injury,

No.70265 of 2025(2) dt.08-10-2025 3/3 let the petitioner, above, named, be released on bail on his arrest or surrender before the court below within a period of four weeks from today on his furnishing bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -1st Class, Saran, Chapra/the concerned court below, in connection with Maker P.S. Case No. 83/2025, subject to the condition laid down under Section 482 (2) of the BNS.
