Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Bidupur P.S. Case No. 284 of 2022 registered for the offence under Sections 456, 379 of the Indian Penal Code.

The accused/petitioner is not named in the F.I.R. and is in custody since 18.07.2022.

The allegation against this petitioner is to snatch the items/articles costing about Rs. 21,515/- from the informant, who is working as a delivery boy.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.9697 of 2023(4) dt.28-06-2023 2/3 submitted that implication of this petitioner with present case is only out of his criminal antecedents, as he found involved in 18 cases, where he is on bail in 16 cases. It is submitted that suspicion arises out of said criminal antecedents, petitioner on the basis of self confession while apprehended in Bidupur P.S. Case No. 11/2020 was remanded in present case without having any connecting material/evidence. It is submitted that petitioner was not put on TIP, as yet. While concluding the argument, it has been submitted that investigation of this case is completed, for which charge-sheet has already submitted, as such, there is no chance of tampering with the evidence.

Learned APP opposed the prayer of bail.

Considering the facts and circumstances as mentioned above, as no incriminating material recovered/surfaced during the course of investigation as to connect petitioner, prima facie, with the present occurrence, coupled with the fact that chargesheet has already submitted, where petitioner is in custody since 18.07.2022, accordingly the petitioner, above named, is directed to be released on bail in connection with Bidupur P.S. Case No. 284 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at
