The petitioner seeks pre-arrest bail in connection with Pirpainti P. S. Case No.88 of 2018 registered under Section 408 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that out and out, a false case has been instituted against the petitioner by the informant of the case. The petitioner, a clerk, superannuated from the Circle Office, Pirpainti in the year 2014 and four years after his retirement, an allegation has been levelled against him that he did not hand over charge of the record of Miscellaneous Case No. 5 and 62 of 2004-05 and some other mutation cases.

Learned Additional Public Prosecutor for the State has

Patna High Court Cr.Misc. No.64707 of 2018(2) dt.12-12-2018 2/2 opposed the application for grant of pre-arrest bail to the petitioner.

Considering the nature of allegation as also the fact that the petitioner has already been superannuated, he is directed to be release, in the event of his arrest or surrender before the court below within six weeks from today, on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-XI, Bhagalpur in Pirpainti P. S. Case No. 88 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J.) kanchan/- U T
