JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-11-2019 Heard learned counsel appearing on behalf of the petitioners, learned counsel appearing on behalf of the informant and learned Additional Public Prosecutor representing the State.
This application for anticipatory bail arises out of Manigachhi P.S. Case No. 126 of 2019 for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307 and 379 of the Indian Penal Code.
The informant is father of Secretary of local Madarsa. Some decision to terminate the employees of Madarsa appears to be background in which the occurrence is said to
Patna High Court CR. MISC. No.68263 of 2019(2) dt.27-11-2019 2/3 have taken place. There is allegation against the petitioners No. 1 and 2 of having torn away the papers of Madarsa. It is alleged against the petitioner No.3 that he along with others assaulted the informant with iron rod and other weapons causing grievous injuries.
Learned counsel appearing on behalf of the informant has submitted that the assault made by the petitioner No.3 could have been fatal and as a matter of fact, the informant had narrow escape, though he has sustained grievous injuries. Be that as it may, considering the background in which the occurrence has taken place, this application is allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Darbhanga, in Manigachhi P.S. Case No. 126 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case
