Petitioner apprehends arrest in a case registered for the offence punishable under sections 379,354B,308,384/34 and other ancillary sections of the Indian Penal Code. As per the prosecution case, three months earlier to the instant case, petitioner and other accused persons had come to the house of the informant and demanded Rs.5 lacs for ensuring release of her husband from the custody. On the alleged date of occurrence, they again came to the shop of the informant, assaulted her by knife and snatched her jewelries and took away Rs.50,000/-.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and had falsely been implicated in
Patna High Court CR. MISC. No.1001 of 2023(2) dt.08-05-2023 2/2 this case. As a matter of fact, husband of the informant is in custody in connection with Araria (Mahila) Police Station Case No. 15/2022 filed for raping minor girl, who happens to be niece of the petitioner. The instant case has been filed out of personal grudge and in revenge. Informant has sustained no injury.
Learned counsel for the State and informant oppose the prayer for bail. They submit that the petitioner inflicted knife blow on the informant, which was found to be grievous in nature by the doctor.
Considering the nature and gravity of allegation, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) shashi/- U T
