2. The petitioner claims himself to be the biological son of deceased employee, namely, Late Ganesh Mandal, who

Patna High Court CWJC No.15384 of 2023(9) dt.16-07-2026 2/3 died in harness on 16.05.2004 while working as a skilled labourer at Electricity Supply Sub-Division, Kahalgaon, Bhagalpur, from his wife namely, Bimla Devi. The private respondent no. 7 claims herself to be the second wife of the deceased employee and each are claiming for the payment of retiral dues from the Electricity Board.

3. Both the parties were asked to file succession certificate but till date, they have not brought on record the same.

4. In such circumstances, retiral dues under different heads must be distributed between the legal heirs of the deceased employee, namely, Ganesh Mandal, as such, all the persons, who are claiming themselves to be the legal heirs of the deceased employee, namely, Ganesh Mandal, may appear before the Managing Director, South Bihar Power Holding Company along with the supporting documents in respect of their respective claim that they are entitled for reitral dues under different heads on account of death of the deceased employee.

5. The Managing Director, South Bihar Power Holding Company is directed to pass order on the basis of documents produced by respective parties claiming their entitlement for retiral dues under different heads and several

6. Accordingly, the present writ petition stands disposed of.
