JUSTICE BIRENDRA KUMAR ORAL ORDER 30-11-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272,273of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act.

From the dickey of the motorcycle of this petitioner, liquor was recovered. The petitioner allegedly fled away leaving the motorcycle at the spot after he saw the police party.

Submission is that petitioner has got no criminal antecedent and the petitioner had given the said motorcycle for use to one of the friends.

No.63930 of 2018(2) dt.30-11-2018 2/2 Considering the aforesaid submission especially the fact that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Khagaria (Gangour) P.S.Case No.579 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as if in future the learned court below will come to know that the petitioner is indulged in criminal activity that would be a ground for cancellation of bail bond by the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
