1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Surajgarha P.S. Case no. 9 of 2023, registered under sections 395, 397 and 412 of the Indian Penal Code.
3. As per the prosecution case, the informant states that over a dispute with respect to the terms of the rent of the informant's vehicle it is stated that one of the five named accused persons took out a pistol and took away Rs.1000/- from his pocket. Thereafter, the informant was forced to abandon his vehicle. He was assaulted. On the crowd gathering over the altercation it is stated that the accused persons made an attempt to escape but three of them were caught which included the petitioner herein.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The manner of occurrence is other than what has been narrated in the FIR. The case of the petitioner stands on a similar footing to that of coaccused Awadh Bind who has been enlarged on bail vide order dated 4.8.2023 passed in Cr. Misc. no. 46213 of 2023. The petitioner is in custody since 8.1.2023 and has no criminal antecedent. Charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner having remained in custody for more than 10 months since 8.1.2023, grant of bail to the above named co-accused Awadh Bind and the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Surajgarha P.S. Case no. 9 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-IInd, Lakhisarai.
