JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2019 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner seeks bail in a case for the offence registered under Sections 307, 504/34 of the IPC and 27 of the Arms At.

The prosecution story, in brief, is that while the son of the informant was grazing his Buffalo in his field, petitioner and other co-accused persons were consuming liquor. In the meantime, co-accused Janardan Rai asked the son of the informant to bring Chakhna. When he refused, Janardan Rai shot fire upon the son of the informant. Subsequently, he was taken to the hospital where his treatment is going on. It has been submitted by learned counsel for the

The petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The allegation of assault is against co-accused Janardan Rai @ Makhi Rai. The petitioner is said to be a member of unlawful assembly. No allegation of assault is alleged against the petitinoer.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, in connection with Barauni (Chakia) P.S. Case No. 409 of 2017.
