JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 The petitioner seeks regular bail in connection with Nawada Town P.S. Case No. 446 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 337, 353, 383, 385, 427 of the Indian Penal Code. Allegation against the petitioner and others is of creating road blockade and also restraining the police officials from discharge of their duty and further of forcing to close the market.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner rather only general and omnibus allegation has been levelled against the petitioner and he has been in judicial custody since 10.07.2018 and co-accused having similar allegation has been

Patna High Court Cr.Misc. No.64928 of 2018(2) dt.05-11-2018 2/2 enlarged on bail by a coordinate Bench of this Court vide order dated 20.09.2018 passed in Cr. Misc. No. 56989 of 2018. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and also the fact that co-accued having similar allegation has already been enlarged on bail, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 446 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
