The petitioner seeks bail in connection with Jogapatti (Shanichari) P.S. Case No. 307 of 2019, registered for the offence punishable under Sections 420 and 409 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case due to some confusion, misunderstanding and misgivings. Further submission is that in the allegation levelled in the FIR, no offence under Section 409 and 420 of the Indian Penal Code is made out against the petitioner. As a matter of fact, it is the proprietor of the miller, who should be responsible for not clearing the CMR of the
Patna High Court CR. MISC. No.66694 of 2019(2) dt.14-11-2019 2/2 Paddy supplied to him. The petitioner has no criminal antecedent and he is in custody since 18.08.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Jogapatti (Shanichari) P.S.
